Profeco Halts Nayarta Property Sales Over Contract Changes

Bahía de Banderas, Nayarit, August 19, 2026 – Property sales at Nayarta in Mezcales have been halted after federal consumer inspectors found differences between the contract presented to buyers and the version registered with Profeco.

The precautionary suspension applies to the Nayarta sales operation managed by REALGATE México S.A.P.I. de C.V. Inspectors placed a suspension seal at the company’s office on Avenida Emilio M. González following a citizen complaint.

Myrna Encinas García, head of Profeco’s Bahía de Banderas consumer protection office, said the verification found changes or alterations to the registered standard-form contract. The company must stop selling properties through the suspended operation while it addresses the findings.

The measure is precautionary and does not amount to a final ruling against Nayarta or REALGATE México. It does, however, prevent new sales from continuing under contract language that differs from the text reviewed by Profeco.

A PVDN review of Profeco’s Public Registry of Adhesion Contracts found three property-sale agreements listed under REALGATE México and the company’s federal tax identification number.

The records include a promise-to-purchase agreement registered in January 2025, a standard home-purchase contract, and a FOVISSSTE no-down-payment agreement. The two latter contracts are dated February 17, 2026, in the public registry. All three entries carry the status ACTUALIZADO.

Each approval document warns REALGATE México that using a contract containing changes, omissions, or modified company information can lead to sanctions under the Federal Consumer Protection Law. The warning covers modifications of any type when compared with the registered model.

That requirement is central to the suspension. Profeco does not approve a general concept that developers may later rewrite. It reviews a specific contract model containing the obligations, payment terms, delivery conditions, cancellation provisions, penalties, warranties, and property information governing the transaction.

Mexico’s NOM-247-SE-2021 housing sales standard requires contracts connected to residential property sales to be registered with Profeco and available to buyers before signing. The contract must display its registration number and date.

The standard also states that differences between the registered contract and the version used with a consumer are treated as unwritten when those differences harm the buyer. Registration does not replace construction permits, land-use approvals, title verification, or other legal requirements tied to the property.

Anyone holding REALGATE México paperwork can search the public registry using the complete corporate name and compare the signed contract and its annexes with the corresponding approved model. The registration number, property description, total price, payment schedule, delivery date, penalties, cancellation terms, and warranties should match.

Profeco’s current complaint instructions ask consumers to submit documents proving the transaction and the commitments made by the provider. Complaints may be presented at an Office of Consumer Defense, through participating online conciliation services, or through the agency’s channel serving people who live outside Mexico.

The Nayarta action follows another property-sales suspension in the same municipality. In April, PVDN reported that Profeco halted sales at Aldea Hortus in Tondoroque after inspectors identified contract and pricing deficiencies.

REALGATE México must resolve Profeco’s observations and return to the approved contract language before the suspended Nayarta sales operation can resume.
