What to Do When Your Vallarta Landlord Refuses Repairs

Under Jalisco law, tenants can seek court-ordered repairs or lease termination when landlords fail to make necessary repairs.

The state’s Civil Code gives tenants those remedies in Article 1998. It also requires rent payments and allows landlords to seek termination for nonpayment.

For this report, I reviewed the current code and Jalisco’s mediation rules. A repair claim does not give tenants a general right to deduct expenses from rent.

How repair disputes affect foreign residents

For a tenant who wants to stay, Article 1998 provides a route to ask a judge to order repairs. Article 2001 also allows requests for reduced rent or an end to the lease over defects that impair the home’s use.

Those remedies address different outcomes. The tenant may want repairs to stay in the home, a lower rent, or a release from the lease. The choice depends on the defect, the evidence, and the legal conditions for each remedy.

Foreign nationality does not remove access to the justice system. Article 11 of Mexico’s Migration Law guarantees migrants access to justice and due process regardless of immigration status.

There is also a local option before litigation. The Instituto de Justicia Alternativa del Estado de Jalisco, or IJA, offers voluntary mediation for contract disputes. Its published procedure allows applicants to identify themselves with a valid passport.

This report concerns residential leases in Puerto Vallarta. Jalisco’s code treats hotel lodging separately; a vacation booking requires examination of its actual agreement. These Jalisco provisions should not be assumed to govern a property across the state line in Nayarit.

Establish who is responsible for the repair

Under Article 1995, landlords must hand over premises fit for the agreed use, with hygiene and safety conditions. They must keep the property in that state through necessary repairs, except those caused by tenant negligence or misuse.

The tenant has duties, too. Article 2019 assigns tenants minor, low-cost repairs arising from use. Article 2005 also makes tenants liable for damage caused by their fault or negligence, or that of family, staff or subtenants.

That division depends on what failed, what caused it, and what the lease included.

For an air-conditioning dispute, that means distinguishing routine servicing from an equipment failure. For a leak, it means identifying the source and documenting the affected rooms. These are questions for an inspection, not conclusions that a photograph alone can settle.

The contract and move-in inventory provide the starting point. Article 2023 calls for the lease to describe the property’s condition, fixtures, accessories and the parties’ added duties.

Puerto Vallarta real estate lawyer Cristo Camacho addressed property-condition clauses in a July 2025 published interview about lease terms. The report also recommended a detailed inventory, photographs, and both parties’ signatures.

“A well-structured clause on this topic can avoid disputes about how the property should be delivered at the end of the contract,” Camacho said.

A disputed maintenance clause still needs legal review. The code allows people to waive some private rights, but protects others against waiver. Tenants should not assume that every clause shifting repairs to them is valid, or that every such clause is void.

Give notice and build a usable record

Under Article 1997, tenants must notify landlords of necessary repairs as soon as possible. They can be liable for damage caused by failing to report the problem.

That obligation makes an early, documented report more useful than waiting for several problems to accumulate. A written request can record the defect, the date it appeared, and the remedy requested.

Based on the code’s notice requirement and the IJA’s intake requirements, I would organize the file into five parts:

  • The agreement: The lease, inventory, deposit receipt, and any written maintenance arrangements.
  • The defect: Dated photographs, video and a description of the affected room, fixture or equipment.
  • The notice: Messages sent to the landlord, replies, acknowledgments and a timeline of earlier reports.
  • The inspection: Any technician’s written findings, proposed work, and itemized estimate.
  • The payments: Rent receipts, bank transfers and invoices for work already authorized.

The repair request should identify the property and unit, describe the problem, and ask for an inspection or work schedule. Include times when access can be arranged. If a call follows, send a written account of what was agreed.

These steps help build a record. They are not a legal notice template. A lawyer can check whether the lease or a court claim requires a specific form of notice.

Articles 1997 and 1998 do not establish a universal 24-hour, 48-hour, or 30-day repair deadline. If the tenant proposes a response date, it should be presented as a request, not an invented legal deadline.

The IJA’s February 2026 intake instructions accept a contract and/or a simple account of the circumstances. Someone without a signed lease can therefore ask about mediation without assuming that the missing document prevents an application.

Do not treat a repair invoice as permission to reduce rent

Rent still matters during a dispute. Article 2005 requires payment in the agreed form and time; Article 2144 lets landlords seek to end leases for nonpayment. Deducting money without agreement creates a separate legal issue from the landlord’s duty to repair.

Article 1998 allows tenants to seek necessary repairs or an end to the lease. It does not create a general right to hire a contractor and subtract the bill from rent.

One option is a written agreement before hiring someone for nonemergency work. The parties can name the repair, the contractor, a spending limit, and who pays. If the landlord will repay the cost through rent, the agreement should state the amount and rental period.

That proposal follows the IJA’s civil mediation guidance, which directs parties toward specific, lawful agreements. It is a negotiated arrangement, not an automatic statutory deduction.

The code does recognize relief in defined loss-of-use situations. Article 2001 concerns defects; Articles 2012 and 2013 address force majeure; Article 2020 addresses loss of use because of repairs. Their conditions differ, including duration requirements in some cases.

Before changing a payment, ask a Jalisco lawyer which provision applies and how to assert it. A delayed response to a maintenance message is not, by itself, proof that those conditions exist.

If the landlord refuses rent receipts, Article 2005 provides for consignation, a formal legal deposit of payment. Keeping the money in a personal account does not accomplish that procedure. Ask counsel how to make the deposit correctly.

Use the local mediation offices with a specific proposal

The IJA describes mediation as voluntary. An impartial facilitator helps the parties seek agreement; the process depends on their participation.

Its current office directory lists two Puerto Vallarta locations. The February 2026 service sheet supplies the neighborhood and office details:

The service sheet lists weekday hours of 9 a.m. to 4 p.m. at both locations. It says entry to the UNIRSE building ends at 2:30 p.m. The directory lists 33-1380-0000, extension 406, for that module; call to confirm intake arrangements.

The institute lists this service as free. Applicants need an original and a copy of valid identification, supporting documents or an account of the dispute, and the other party’s name and contact details.

Its online registration form requires a CURP, Mexico’s population registry code. The in-person requirements accept a passport. A foreign tenant without a CURP can ask the local office about applying in person.

For a repair dispute, a proposal can identify the required work, completion date, access arrangements, and payment responsibility. If the tenant prefers to leave, the discussion can instead address a departure date, remaining rent, and the deposit.

The institute’s agreement-validation guidance explains that agreements meeting its legal requirements can gain the force of a court judgment. They must pass the required review and approval process. A private promise or a draft lacking that approval does not have the same status.

If the landlord does not participate or the parties decline an agreement, the IJA’s procedure preserves their right to pursue other legal routes. Filing an application does not guarantee a repair.

Choose the right legal route if agreement fails

For a necessary-repair claim, Article 1998 points to a judge when the tenant wants to compel the landlord to act. Article 2001 supports requests for lower rent or an end to the lease over qualifying defects. That includes defects arising during the lease without tenant fault.

Article 2001 also contains an exception when the tenant knew about the defects before signing. Move-in records and later repair promises therefore belong in the lawyer’s file, alongside evidence of the current condition.

For a legal consultation, identify the outcome being sought: repairs while remaining in the property, a rent adjustment, or termination. Ask for the legal basis, evidence needed, and a written estimate of professional fees and other expenses.

Jalisco’s Procuraduría Social has a separate legal-assistance service for people with limited means. Its governing law makes free civil assistance subject to a socioeconomic assessment. Free IJA mediation should not be confused with automatic eligibility for free representation.

Profeco should not be assumed to function as a residential tenancy tribunal. Article 73 of the Federal Consumer Protection Law limits its real-estate coverage to specified provider activities involving housing development, construction, advice, sales and timeshares.

On that statutory wording, an ordinary private residential repair dispute belongs on a different legal track. A separate complaint involving a commercial accommodation service or provider requires its own assessment.

Language assistance also deserves attention before signing a settlement. Article 14 of the Migration Law provides for an interpreter when a migrant does not speak or understand Spanish. Ask the receiving authority how that assistance will be arranged for the proceeding.

If leaving is the solution, document the end of the tenancy

Moving out and resolving the lease are separate matters under the code. Articles 2009 and 2010 address rent through surrender and possible liabilities for early return. Special residential provisions can alter the analysis, so a fixed-term tenant should have the applicable rules checked.

A negotiated departure can address the same issues through mediation. The IJA’s agreement process provides a route to put the parties’ obligations into a document subject to legal review.

For that discussion, prepare an itemized proposal covering the final occupancy date, key handover, rent balance, utilities, and deposit. Identify any repair expenses still disputed. Ask the facilitator or lawyer to specify payment amounts and dates rather than leaving them for a later conversation.

The code also addresses money left owing to tenants. Article 1995 requires its return when the contract ends. Under Article 2002, a landlord asserting a claim against that balance must deposit it with a court.

The handover record should show who received the keys, when possession was returned, and the property’s condition. Attach the final photographs and record any disagreement. If an IJA agreement is later breached, its published procedure allows a party to request certified copies and seek enforcement before the competent judge.
