Jalisco human rights agency cites police abuse against gay couple in Puerto Vallarta

A human rights finding has put Puerto Vallarta’s police force back under scrutiny after a gay couple said a night out in the Zona Romántica ended in detention, injury, and a forced payment. The case now carries formal weight from Jalisco’s human rights agency, which found violations tied to liberty, legal security, personal integrity, and discrimination. For a city that relies heavily on its LGBT+ reputation, the next steps by local officials will be closely watched.

Police Abuse Ruling Tests Puerto Vallarta LGBT Image

The Jalisco State Human Rights Commission found that Puerto Vallarta municipal police violated the rights of a gay couple detained in the Zona Romántica in July 2024.

The case involves Christopher Duifhuis Rivera and Juan Manuel López López, a couple from San Luis Potosí who were visiting Puerto Vallarta. According to the finding, they were stopped during the early morning of July 19, 2024, after police accused them of using illegal substances in public.

Toxicology tests taken the same day reportedly came back negative. Despite that, the men were taken into custody and faced an administrative sanction of either 36 hours in detention or a fine.

The couple paid 4,142 pesos to secure their release.

What the human rights finding says

The CEDHJ’s Propuesta de Conciliación 67/2026/III determined that the couple’s rights were violated in several areas. These included personal liberty, legal security, personal integrity, and non-discrimination.

The finding also said police used restraint devices that left visible injuries on the men’s wrists. That point is important because it moves the case beyond a dispute over a fine or a late-night stop. It focuses on how the police used force and how the detention was handled.

The case has drawn attention because it happened in one of Puerto Vallarta’s most visible tourism zones. The Zona Romántica is also closely tied to the city’s LGBT+ tourism economy and its public image as an inclusive destination.

What Puerto Vallarta has been asked to do

The CEDHJ called for municipal action against the officials involved. The mayor was asked to instruct the public security commissioner to complete administrative responsibility proceedings involving four police officers.

The finding also calls for a review of the former municipal judge who handled the case. If wrongdoing is confirmed, the CEDHJ said a note should be added to the judge’s employment file.

Another key point is the reimbursement of the 4,142 pesos paid by the couple. The human rights agency found the sanction lacked a sufficient legal basis.

The city’s internal control office was also asked to conclude Administrative Responsibility Procedure 38/2024 with proper legal reasoning and respect for due process.

A wider public safety concern

The case does not only affect the two men involved. It raises broader questions about police conduct, tourist safety, and the treatment of LGBT+ residents and visitors in Puerto Vallarta.

Local LGBT+ advocates had been following the case since 2024. At the time, community groups said the couple’s experience reflected concerns that had circulated among some residents and visitors for years, especially after late nights in the city’s nightlife areas.

For Puerto Vallarta, the issue is sensitive. The city benefits from its reputation as one of Mexico’s leading LGBT+ destinations. That reputation depends not only on events, nightlife, and tourism promotion, but also on whether visitors feel safe when dealing with local authorities.

The next question is whether the municipality accepts the finding fully and follows through on the requested actions. That includes disciplinary review, reimbursement, and a closer look at police protocols in areas with heavy tourist and nightlife activity.
