Tragic Incident in Puerto Vallarta: Family Files Lawsuit Against Hotel Following Toddler’s Fatal Fall

Puerto Vallarta, Mexico – A family vacation to Puerto Vallarta took a tragic turn for Anastasia Duboshina and James Carter, an American couple who lost their almost two-year-old son, Nico, in a horrifying accident at the Hyatt hotel. The family has recently filed a lawsuit against the hotel for negligence and misconduct, claiming that a missing glass panel led to their son’s death.

The Carter family arrived in Mexico to experience what they hoped would be an unforgettable vacation. Their journey took a devastating turn when their son Nico fell from the hotel’s ninth floor, plunging approximately 30 meters to his death.

In a heart-wrenching account of the incident, James Carter, who was in the same room preparing to go to breakfast, told CBS 8 how life as he knew it changed in a split second. “Nico was standing right in front of me. You couldn’t see that a glass panel was missing. I saw my son die in front of me,” he said.

The family shared the last image of Nico moments before the fatal incident, capturing the toddler blissfully enjoying the beach view from the balcony of the hotel room. However, the same image unwittingly highlighted the negligence leading to the child’s demise.

According to the parents, neither they nor Nico realized that one of the window panels was missing. Anastasia Duboshina stated in the lawsuit filed on October 5, “Since the panels are clear, it was not possible to discern that one of the panels was missing visibly.”

As Anastasia stepped out of the hotel room door to announce she was ready to leave, she saw her son falling. “My world shattered in a second. Nico’s death was so absurd and completely avoidable,” she expressed.

The family has taken legal action against the hotel, accusing the establishment of negligence and misconduct. They insist that the missing glass panel created a life-threatening situation that led to their son’s death. “The hotel complex has a responsibility for this preventable loss, and we aim to hold them accountable,” the lawsuit reads.

In an interview with Telemundo, the parents revealed that they had chosen the Hyatt Hotel for their stay due to its reputation for having excellent family spaces.

Through legal avenues, the Carter family hopes not only to find justice for Nico but also to prevent such incidents in the future, thereby protecting other families who might find themselves in similarly precarious situations.

The lawsuit is ongoing, and the hotel has yet to release an official statement regarding the incident.
